Privacy Policy

INTRODUCTION

This Privacy Policy describes how National Stock Exchange of India (“NSE”) may collect, process, store and/or use User’s information when they access / visit https://www.nseindia.com/ or its mobile application ‘NSE India’ (“Website” / “Mobile Application”). This Privacy Policy is to be read along with the Terms of Use, Disclaimer and other applicable policies.

This Privacy Policy shall apply to the Website / Mobile Application and shall not in any manner be construed to apply to any Third-Party Sites (as defined below) which may be linked to the Website / Mobile Application. NSE shall not in any manner be responsible for the security and/or the privacy practices of such Third-Party Sites or the information shared by the User with such Third-Party Sites and that they shall be governed by their respective privacy policies / terms of use etc.

COLLECTION OF DATA AND PURPOSE

User can visit the Website/Mobile Application without telling NSE who they are and without revealing any information about themselves. The Website/Mobile Application does not automatically capture any specific Personal Information from the User that allows NSE to identify them individually. However, NSE may require certain Personal Information from the User for Specified Purpose.

For the purpose of this Website/ Mobile Application, (i) “Personal Information” shall mean any data or information about an individual who is identifiable by such or in relation to such data and includes details of an individual such as name, phone number, email address, PAN etc.  (ii) “Specified Purpose” means the specific purpose for which facilities / services are opted on the Website/ Mobile Application by the User in accordance with the privacy policy, Terms of Use and applicable laws and regulations. All other capitalised terms in this Policy shall have the same meaning as construed in the Terms of Use.

The availing of such facilities or services and providing of the Personal Information is at the sole discretion of the User(s) and further any such information provided by any User will be on an ‘as on’ basis and NSE shall not be responsible for its authenticity, accuracy and completeness. Any Personal Information so provided and collected shall only be used for the Specified Purpose for which it may be required. In case of User applying for employment at NSE, she/he may send their Resume, containing their personal, academic, and professional background on the email-id as mentioned on the Website / Mobile Application.

In an event User chooses not to provide Personal Information as may be required for the provision of any facility / services, User may not be allowed / permitted to use the facility / services.

NSE does not rent, sell, or share Personal Information about User with third parties or non-affiliated companies except if the User has specifically requested, or under the following circumstances:

• To fulfil User’s request for providing services/facilities.
• To deliver any notices, alerts, or communications relevant to User’s use of the service, as may be applicable.
• To provide such services through authorized service providers / vendors who work on behalf of or with NSE under strict confidentiality agreements.
• To respond to court orders, regulatory authorities, or legal process, or to establish or exercise its legal rights or defend against legal claims.
• In order to investigate, prevent, or take action regarding illegal / criminal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or otherwise, where NSE believes it is necessary.

User may deactivate its account any time it wishes and provide with a written request for removal of its Personal Information from the Website/ Mobile Application. However, it may be noted that services for which such Personal Information has been provided to NSE may get discontinued upon removal of such Personal Information. NSE intends to protect the quality and integrity of User’s Personal Information. NSE will make a sincere effort to respond in a timely manner to User’s requests to correct inaccuracies in their Personal Information as provided by User, basis such evidence / information / data / documents as may be required by NSE (on a case to case basis) for verification and review. However, NSE shall have the final authority and right to accommodate any such change requests.

NSE sometimes collects anonymous information from Users visit to the Website / Mobile Application to help provide better services. For example, NSE keeps track of the domains which the User visits and User activity on the Website/ Mobile Application, but NSE does so on anonymous basis and none of this information is reviewed at an individual level. NSE directly or through its affiliates or vendors may use this data to analyse trends, patterns and statistics and to help User provide better customer service. NSE maintains confidentiality for this information.

USER Consent

User hereby grants their express consent (and includes electronic consent by way of OTP) to NSE to access their Personal Information for authentication and retrieval of their securities holding / transaction information executed through their SEBI authorised brokers on NSE platform for availing My Portfolio facility.  

User is responsible for maintaining the confidentiality of his/her login credentials at all times and ensuring that it is not shared with any unauthorized person.

RETENTION OF DATA

Personal Information shall only be retained in system for the Specified Purpose and for the legal and compliance requirements, if any, for such time as may be statutorily required to be maintained.

CHILDREN

This Website/Mobile Application is not intended for use by children and minors below the age of 18 (eighteen) years. Parents are requested to ensure that Personal Information is not provided by minors.

DATA SECURITY

The User's right to privacy is of paramount importance to NSE. Any information provided by User will not be shared with any third party, except to affiliates of NSE and vendors for the Specified Purpose.

NSE takes reasonable steps to protect User’s information and adopts reasonable industry standard information security practices. However, User acknowledges, understands and accepts that NSE cannot guarantee or warrant a 100% security in relation to protection of their information. NSE does not in any manner guarantee that the Website / Mobile Application shall remain free from any malware attacks, hacking, cybercrimes, cyberattacks or similar third-party interferences / indulgence which may hamper the data security measures adopted by NSE. NSE and /or its affiliates may undergo verification by third party entities regarding its use of SSL encryption technologies and may also be audited by third party auditor to review NSE’s security practices as may be required from time to time.

NSE may utilize internet protocol (IP) addresses to identify and resolve server issues as well as to manage the Website / Mobile Application, as the case may be. In an event of a detection of a security breach, virtual threat, damage, misuse or such other incidents that may in the opinion of NSE threaten the security, infrastructure and operations of the Website / Mobile Application, NSE reserves the right to use and/or link any and all information and data including but not limited to IP address, domain name, browser type, operating system, country of origin, the date and time of the visit and the pages visited etc., to evaluate, mitigate, investigate and eliminate the risks, issues associated with such security breach, threats, damage etc., and further take such appropriate steps and actions including but not limited to blocking the IP address of any User and/ or take any other legal action as may be required.

COOKIES

By accessing the Website / Mobile Application User understands and agrees that NSE may use cookies which may be used to improve and enhance the overall experience as intended by NSE. Cookies are typically used to recognize frequent / returning users to the Website / Mobile Application, track User interactions with Website / Mobile Application. Although cookies do not collect Personal Information, they do identify User’s computer / device and associated resources. NSE does not in any way control any cookie usage by third party websites hosted on NSE Website/Mobile Application. It may be noted that, if User rejects / denies cookies, certain features of the Website / Mobile Application may not function in the way as intended. User also agrees that, by default, most of the browsers automatically accept cookies, however the same may be subject to change if the browser enables the User to do so basis their preference.

LINKS TO OTHER WEBSITES / THIRD PARTY APPLICATIONS

This Website/ Mobile Application may provide link(s) and access to other third-party mobile application(s)/websites/advertisements/any other link(s), or such other platform(s), mobile applications including users, advertisers, affiliates and sponsors of the Website / Mobile Application (hereinafter collectively referred to as “Third-Party Sites”) which would be governed by their respective privacy policies, terms of use and other conditions, as the case may be. User agrees that NSE is not responsible for the availability of, and content provided on, Third-Party Sites, including opinions, advice, statements and advertisements, and User shall bear all risks associated with the use of such content. Further, the said Third-Party Sites are not under the control of, or in any way, affiliated or associated with NSE through this Website / Mobile Application. NSE has no control over the nature, content and availability of such Third-Party Sites. The inclusion of any such links does not in any manner imply that NSE recommends and / or endorses the views / information / contents / services / products expressed by or within them. NSE is not responsible and/ or liable for any loss or damage of any sort which User may incur from dealing with any third party.

CHANGES / REVISIONS TO PRIVACY POLICY

NSE reserves the right to amend / change / revise the Privacy Policy at any time and from time to time without any notice to User. Such amendment / change / revision shall come into effect immediately upon the posting of this Privacy Policy, unless otherwise stated.

User is responsible for periodically checking the Privacy Policy. In an event User continues to use, visit, access and/or interact with the Website / Mobile Application, it shall be deemed to mean that User has accorded its approval / consent on the said changes / revisions / amendments etc.
